Promotional Period	Starts: 25 Jun 2019, 9am Closes: 2 Jul 2019, 11pm
Entry Restrictions	The Promotion is only open to people who have, via the relevant intermediary’s platform during the Promotional Period: expressed an interest in investing in the Promoter’s second crowd-sourced funding (CSF) offer; and committed to an investment in that CSF offer within the Promotional Period. The Draw will only take place and the Prize will only be awarded if the Promoter meets any minimum investment requirements stipulated for the CSF offer, currently set at $1.5 million. All entrants must be aged 18 years or over and a resident of Australia.
Entry Procedure	Each person who satisfies the Entry Restrictions will receive one (1) entry into the draw.
Maximum Number of Entries	Unlimited.
Draw Details	The prize draw will be a random selection from all valid entries received during the Promotional Period.  The first entry drawn at random will win the major prize.  Time/Date: 10.00am AEST, 6 Aug 2019 Location: 142 Gertrude St, Fitzroy, Melbourne
Prize and Prize Details	One (1) prize consisting of a trip for two (2) people for three (3) nights at the residence Amileka, 30 minutes from Byron Bay, with four (4) days car rental of a Tesla Model X.  The prize includes: return economy airfares for 2 people to Ballina, departing from the winner’s nearest Australian capital city airport (estimated cost of $600 per ticket; total estimated cost $1200) . 3 nights accommodation for 2 people at Amileka residence (www.amileka.com.au), near Federal, NSW (estimated cost $5010)  4 days rental of a Tesla Model X vehicle (estimated cost $1000) with one driver over at least 30 years of age holding a valid driver’s license.
Prize Restrictions / Exclusions (if any)	Prize is not transferable and non-negotiable and cannot be returned or exchanged (whether in whole or in part).   The Draw will only take place and the Prize will only be awarded if the Promoter meets any minimum investment requirements stipulated for the CSF offer, currently set at $1.5 million.
Total Prize Pool	Total maximum prize pool valued at approximately $7,210 (ex. GST).
Notification of Winner(s)	The winner will be contacted via email and/or telephone within two (2) days of the prize draw.
Publication Details of Winner(s)	The winner will be published on the Promoter’s website at https://www.dcpowerco.com.au/competitions within two (2) days of the Prize Draw.
Prize Claim Date	The prize must be claimed within 28 days after the Prize Draw.
Unclaimed Prize Draw Details	The Promoter will attempt to make contact with the winner over 28 days, after which, a new winner will be drawn.
Unclaimed Notification/Publication Details	Any unclaimed prize winners will be contacted via email and/or telephone within two (2) days of the unclaimed prize draw. Any unclaimed prize winner will be published on the Promoter’s website at https://www.dcpowerco.com.au/competitions within two (2) days of the unclaimed prize draw. The Promoter will publish the winner’s names. By entering this competition, you agree that promotional photographs may be taken and reasonably used by the Promoter.

 

 

Terms and Conditions 

 

GENERAL

1. These terms must be read together with the Schedule for this Promotion. The Schedule defines terminology used in these Conditions of Entry. Participation in this Promotion constitutes acceptance of these Terms of Entry. Where there is any inconsistency between the Schedule and these terms, the Schedule prevails. 
2. By submitting your entry or agreeing to enter, you agree that these Conditions of Entry apply to your entry. 
3. The Promoter is DCP Company Ltd of 142 Gertrude St Fitzroy, VIC 3065 (Promoter, we, us).

 

WHO CAN ENTER, AND WHO CAN’T

1. The eligibility requirements for this Promotion are set out in the Entry Restrictions. The Promoter may, in its discretion, require any person taking any prize to be 18 years of age or over. 
2. Directors, managers, employees, officers, agents and contractors of the Promoter, and their immediate families (i.e. spouse, partner, parent, grandparent, natural or adopted child, and sibling (whether natural or adopted by a parent)) are ineligible to enter. 

 

HOW TO ENTER

1. To enter the Promotion, you must follow the Entry Procedure during the Promotion Period.
2. If the Promotion cannot run for reasons beyond our control (for example, infection by computer virus, mobile network failure, bugs, tampering, unauthorised intervention, fraud, or technical failures), we reserve the right to cancel, suspend, modify or terminate the Promotion. If that happens, we’ll select a winner from eligible entries received at the time. 
3. All decisions made by us regarding any aspect of the Promotion are final, and no correspondence will be entered into. 

 

PRIZE

1. The prize(s) are set out in the Prize Details and are subject to any restrictions specified in the Prize Restrictions/Exclusions. Prize values are accurate as at the commencement date of the Promotion. Any variation after that date is beyond our control. All costs, fees, charges or expenses associated with the prize(s), which are not specified in the Schedule, are the responsibility of the winner(s). 
2. Prizes are not transferable, exchangeable or redeemable for cash. If for any reason a prize is not available, we will substitute it for another prize of equal or higher value (in our discretion). 
3. If the prize (or part of the prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.

 

HOW THE WINNER(S) ARE CHOSEN AND NOTIFIED

1. The draw/s will be conducted in accordance with the Draw Details. The judges’ decision is final, and no correspondence will be entered into. 
2. We will notify winners, and publish their names, in accordance with the Notification of Winner(s) and Publication of Winner(s) information set out in the Schedule. 
3. If (having made reasonable efforts) we cannot contact a prize winner, or if any prize is not accepted or claimed by the Prize Claim Date, that prize winner’s entry will be deemed invalid, and we reserve the right to distribute unclaimed prizes via the Unclaimed Prize Draw. 
4. At our request, prize winners must sign an indemnity and exclusion of liability form provided by us. If a winner does not sign that form within the time specified by us, they will not be able to participate and that winner’s entry or prize claim will be declared invalid. 
5. If you are a winner, you are responsible for your use of the prize, including complying with all relevant laws and any applicable terms and conditions of use. 
6. If any prize is not claimed in accordance with these terms, the relevant winner’s entry will be deemed invalid and the Promoter reserves the right to conduct such further draws on the Unclaimed Prize Draw Date as are necessary to distribute the prize/s, subject to any directions given by any relevant authority. If required by law or any relevant authority, the winner/s will have their name and state of residence published in accordance with the Unclaimed Prize Draw Publication Details. 

 

WHERE THE PRIZE INCLUDES TRAVEL

1. Conditions may apply where a Prize includes travel by any means, such as air, bus or train and whether domestic or international (such travel being provided by a travel provider determined by the Promoter (Travel Promoter).
2. The Promoter may require te any winners to travel or not travel on certain days/dates including blackout periods which include (but are not limited to) Christmas, New Year, public holidays, and school holidays in the departure or arrival city/country).
3. Unless otherwise specified:
   1. all additional expenses associated with the travel by the winner and any travelling companion(s) including spending money, meals, taxes, insurance, passports, visas, vaccinations, transport to and from departure points, transfers, items of a personal nature, in-room charges, and all other ancillary costs are not included in the Prize. Travel and other insurances are not included as part of the Prize. The Promoter highly recommends that the winners take out travel and other insurances;
   2. the winner and any travelling companion(s) must:
      1. travel at the same time;
      2. depart from the same airport, which must be the primary airport of the winner’s capital city (or such other regional airport as determined by the Promoter in its sole discretion);
      3. arrange at their own costs any transport to and from the airport.
4. The Travel Provider may impose its own conditions of carriage on the Prize (which it may amend or substitute at its sole discretion from time to time).
5. The Promoter:
   1. is not responsible for the cancellation, delay or rescheduling of any part of the Prize or any costs incurred by the winner or any travelling companion(s) as a result (including but not limited to accommodation costs), which will be the sole responsibility of the winner;
   2. makes no representations as to the safety conditions or other issues that may exist at any destination and offers no advice in relation to international travel, such information should be obtained from government and local consular offices as appropriate).

 

ENTRANTS AGREE TO PROMOTIONAL ACTIVITIES

1. Entrants consent to the Promoter using their name, likeness, image, voice and/or social media posts content in the event they are the winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this Promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter. 
2. Entrants must, at the Promoter’s request, participate in all promotional activity (such as publicity and photography) surrounding this competition or the winning of any prize, free of charge, and they consent to the Promoter and its related bodies corporate using their name and image in promotional material. Without limitation, entrants consent to being broadcast, filmed, photographed or otherwise recorded without compensation while participating in this competition, or any Challenge involved in this competition, or in taking or using any prize, and they consent to the Promoter repeating any such broadcast, film or other recording at any time. 
3. If due to any reason whatsoever the Promoter becomes aware after an entrant has won a prize that the entrant has not complied with these terms, that entrant will have no entitlement to the prize, even if the Promoter has announced them as a winner and that entrant will be required, at the direction of the Promoter, to return, refund or otherwise make restitution of the prize. 
4. If an entrant is unable to or refuses or fails to take part in any element of this Promotion, or a winning entry is deemed not to comply with these terms, the Promoter reserves the right to discard that entrant’s entry and proceed as if that entrant had not entered the Promotion 
5. By participating in this Promotion, you understand and agree that Promoter may use and disclose the personal information provided by you for the purpose of conducting the Promotion and for any of the purposes set out in our Privacy Policy (available at https://www.dcpowerco.com.au/privacy/), which contains information about how you may access and seek correction of your personal information or complain about a breach of your privacy, and how we will deal with that complaint. We may also disclose your personal information to other parties, including our third party service providers. From time to time, these third parties may be located (and so your personal Information may be disclosed) overseas, including in India, the USA and the UK, and other countries from time to time. We may use your personal information for direct marketing purposes, unless you opt out (which you can do at any time in accordance with our Privacy Policy). 
6. Without limiting any other paragraph, the Promoter may at its discretion amend any aspect of this competition or of these terms, subject to applicable laws and subject to the approval of the relevant authorities in each Relevant State, if required. 
7. You will be responsible for any tax liability associated with a prize. 
8. To the extent permitted by law, we will not be liable for any loss or damage whatsoever (including direct or consequential loss) or personal injury suffered or sustained in connection with the prizes or this Promotion. 
9. We accept no responsibility for any tax liabilities that may arise from winning a prize. 
10. The Promoter and its associated agencies and companies will not be liable for any loss (including, without limitation, indirect, special or consequential loss or loss of profits), expense, damage, personal injury or death which is suffered or sustained (whether or not arising from any person’s negligence) by any person in connection with this Promotion or accepting or using any prize, except for any liability which cannot be excluded by law (in which case that liability is limited to the minimum allowable by law). 
11. These Conditions of Entry are governed by the laws of Victoria.
